1. About These Terms
These Terms of Service (the Terms) govern access to and use of ImOnHere, including our website, creator profiles, account features, analytics, links, subscription features and related services (together, the Service). By creating an account, activating a creator profile or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
ImOnHere is operated by Content Creator Technologies Ltd (ImOnHere, we, us or our). These Terms should be read with our Privacy & Cookie Policy and Community Standards & Acceptable Use Policy.
2. What ImOnHere Is
ImOnHere is a creator-profile, link-in-bio, analytics and discovery service. It gives creators a customisable online presence through which they can present profile information and links to websites, social platforms and other independent third-party services.
ImOnHere hosts the profile information and limited profile assets needed to provide the Service. It does not host or distribute the underlying content that creators produce for their audiences, and it is not a marketplace for that underlying creator content.
Third-party websites and services linked from an ImOnHere profile operate independently from ImOnHere.
3. Beta and Developing Service
ImOnHere is launching in phases and may make parts of the Service available as beta, preview or early-access functionality. During these stages, features may be incomplete, changed, tested with limited groups, interrupted or withdrawn as we improve the Service.
We may add, remove, replace or modify features from time to time. We will not use this clause to remove rights that cannot lawfully be excluded or to avoid obligations that already apply to a paid service you have purchased.
4. Eligibility and Accounts
You must be legally capable of agreeing to these Terms. If the Service or a particular feature has a stated minimum-age requirement, you must satisfy that requirement. Where parental or guardian consent is legally required, it must be obtained before the relevant person uses the Service.
You must provide information that is accurate and reasonably current, keep your login credentials secure and take reasonable steps to prevent unauthorised access. You are responsible for activity carried out through your account unless it results from circumstances for which the law makes us responsible.
You may not create an account for the purpose of impersonating another person, misleading users, evading enforcement or carrying out unlawful, fraudulent or abusive activity.
5. Creator Profiles and Public Information
ImOnHere creator profiles are intended to provide creators with a public online presence. Information and assets you choose to publish on a public profile may therefore be visible to other people.
Unless you choose otherwise using the visibility controls available within your account, your published creator profile may be displayed, indexed, searched, categorised, recommended or otherwise surfaced within ImOnHere and its current or future discovery features.
By publishing a creator profile, you authorise us to display and process the public profile information you provide as reasonably necessary to operate, improve, promote and provide the Service and its profile-discovery functionality.
You may hide your profile from public ImOnHere search and discovery features at any time using the applicable visibility setting. Hiding a profile from search or discovery does not necessarily make the profile private: for example, a person with its direct address may still be able to access it unless you separately unpublish, deactivate or otherwise restrict the profile.
Visibility changes may take a reasonable period to propagate. Copies already cached or indexed by independent search engines or other third parties may remain visible until those third parties refresh or remove them.
6. Public Creator Profiles and Discoverability
You retain ownership of the profile information, images, branding and other material that you own and submit to ImOnHere (Your Content). You must have the rights and permissions needed to upload, publish and link to Your Content.
You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, resize, display, transmit and otherwise use Your Content only as reasonably necessary to operate, secure, improve, promote and provide the Service, including displaying your public profile through ImOnHere discovery features. This licence ends when the relevant content is removed from our systems, subject to reasonable backups, legal retention requirements and material already lawfully used before removal.
ImOnHere and its software, branding, designs, databases and other materials supplied by us remain owned by us or our licensors. These Terms do not transfer those rights to you.
7. Links and Third-Party Services
Creators may add links to independent third-party websites and services, subject to our policies. We do not control those destinations and are not responsible for their availability, content, products, security, privacy practices, terms or transactions.
A link from an ImOnHere profile does not mean that we endorse, sponsor or guarantee the destination. Your relationship or transaction with a third party is between you and that third party unless we expressly state otherwise.
ImOnHere charges for ImOnHere software and services. We do not take a percentage of transactions made through independent third-party platforms merely because a creator links to them from an ImOnHere profile.
8. Acceptable Use
You must use ImOnHere lawfully and in accordance with our Community Standards & Acceptable Use Policy. Among other things, you must not use the Service for fraud, scams, malicious links, unlawful activity, exploitation or abuse, impersonation, infringement of intellectual-property rights, harassment, threats, malware, deceptive destinations or attempts to compromise the Service or other users.
We may use warnings, visibility restrictions, link restrictions, content removal, account suspension or account termination where reasonably necessary to enforce these Terms, protect users, comply with law or protect the Service.
9. Sensitive and Adult Destinations
Lawful external destinations containing adult or other sensitive material may be permitted where they comply with our Community Standards and applicable law. We may require age or sensitive-content labels, interstitial warnings, visibility restrictions or other safeguards.
ImOnHere does not host, sell or process payments for sexually explicit creator content. Illegal sexual content, sexual exploitation, non-consensual sexual material and any sexual content involving minors are strictly prohibited.
10. Basic Plan
The current ImOnHere landing page describes the Basic plan as $0 forever, with a customisable profile, unlimited links, core analytics, standard support and 90-day analytics history. Features may develop over time, but we will not describe a plan as paid without clearly telling you before you choose to purchase it.
Free services may be subject to reasonable technical, security, anti-abuse and fair-use limits
11. Pro Plan and Paid Services
The current advertised standard price for Pro is $4.99 per month. The current Pro feature set includes a custom domain, enhanced customisation, enhanced analytics, enhanced links, traffic sources and locations, full analytics history and priority support.
Before any paid subscription begins, the checkout process will show the applicable price, currency, billing period and material subscription terms. Taxes may be added where required. Payment processing may be provided by an independent payment provider whose own terms and privacy practices also apply.
Paid subscriptions renew only in accordance with the terms shown when you subscribe. You may cancel a recurring subscription through the cancellation method made available to you. Cancellation normally prevents the next renewal rather than retrospectively cancelling a period already supplied, subject always to any statutory cancellation, refund or consumer rights that apply.
Nothing in these Terms limits mandatory consumer rights or any refund, cancellation or remedy that the law says cannot be excluded.
12. Founding Creator Offer
ImOnHere may make a limited Founding Creator offer available to early creators. The current landing page refers to the first 500 creators and states that Pro is free for Founder Creators. Eligibility is not created merely by submitting an email address unless we confirm that you have qualified and activated the relevant account.
We may close the Founding Creator intake when the stated allocation or promotional period is complete. We will not retrospectively remove a confirmed promotional entitlement except where these Terms permit suspension or termination for misuse, fraud or another material breach.
13. Analytics
Analytics are provided to help creators understand activity relating to their ImOnHere presence. Metrics may be affected by privacy settings, consent choices, blockers, bots, network conditions, third-party systems and technical limitations. Analytics are therefore informational and are not guaranteed to be complete or perfectly accurate.
We do not guarantee any particular level of profile views, traffic, followers, ranking, discoverability, audience growth, revenue or other commercial result.
14. Verification and Other Optional Features
We may offer optional verification or other paid or free features. Where we do, the applicable eligibility requirements, price and material conditions will be shown before purchase or activation. Verification, where offered, relates to authenticity and does not guarantee ranking, recommendation, traffic, followers or commercial results.
15. Suspension and Termination
You may stop using the Service at any time and may use the account controls made available to unpublish, deactivate or request deletion of your account, subject to applicable retention requirements.
We may restrict, suspend or terminate access where reasonably necessary because of a material or repeated breach of these Terms or our policies, fraud, security risk, unlawful activity, legal requirement, harm to users or the Service, or non-payment of an amount properly due. Where appropriate and lawful, we may provide notice or an opportunity to remedy the issue.
16. Availability and Changes
We aim to keep ImOnHere available and reliable, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, security work, third-party outages, internet failures, beta development and events outside our reasonable control may affect availability.
We may update these Terms where reasonably necessary, including for new features, legal requirements, security, operational changes or changes to the Service. If a change materially affects your rights or a paid service, we will provide reasonable notice where required by law.
17. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.
Subject to those rights, we are not responsible for losses caused by independent third-party websites or services, creator-controlled content, or events outside our reasonable control. If you use ImOnHere wholly or mainly for business purposes, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or anticipated savings to the extent permitted by law.
18. Privacy
Our Privacy & Cookie Policy explains how we collect and use personal information, including information associated with creator accounts, public profiles, analytics and website technologies. Public profile information may be processed to provide search, recommendation and other discovery functionality as described above.
19. Governing Law
These Terms are governed by the laws of England and Wales. If you are a consumer, this does not deprive you of mandatory protections available under the law of the country in which you live, where those protections apply. Courts with jurisdiction under applicable law may hear disputes arising from these Terms.
20. General
If a provision of these Terms is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not necessarily waive it. We may transfer our rights and obligations as part of a restructuring, financing, sale or transfer of the Service, provided this does not reduce mandatory rights that apply to you. You may not transfer your account or contractual rights where doing so would breach these Terms or applicable law.
